He was in charge of the controversial inquiry into former Prime Minister Edward Heath when he was with Wiltshire Police.
In Parliament, Home Officer Minister Lord Sharpe said that the government stepping in is a “last resort”.
A date for the misconduct hearing has not yet been set.
