Jennifer Melle was suspended after speaking publicly to the media about receiving a warning for using the wrong pronouns.
It followed an incident in 2024 where she was racially abused by a transgender patient after she addressed them as “Mr”.
The hospital trust said it was concerned confidential details about the patient’s appearance, diagnosis and treatment were shared.
An internal disciplinary meeting at Epsom and St Helier NHS Trust, where she worked, has now cleared her of further action.
A statement released by Epsom and St Helier NHS Trust said;
We are sorry that our member of staff experienced threatening and racially offensive language. In response we warned a patient that they would be excluded from our care if this behaviour continued.
Everyone working in the NHS has a legal duty to keep patient information confidential and the member of staff has been reminded about their responsibilities. Confidential information includes the diagnosis and treatment.
Nurses must also follow professional standards such as the Nursing and Midwifery Council’s code of conduct – this includes maintaining confidentiality for any patients in their care at all times. NMC guidance can be found here: The Code
Although details including their physical appearance, diagnosis and treatment were shared publicly, we are not aware that anyone has identified the patient.
