Peers rejected an amendment to The Victims Bill, originally tabled by Sarah Olney in the Commons, by 211 to 82.
It would have meant free access to court transcripts for sexual assault victims after some were quoted up to £22,000 to view documents.
Ms Olney says the charge is not right.
The Ministry of Justice said a pilot for sexual offence victims was already due to begin this spring.
